§ 38-242. Penalties.

  • (a)

    Any person who violates any provision of this article shall be subject to punishment as prescribed in section 1-12.

    (b)

    Any violation of the provisions of this article is declared to be a public nuisance and may be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction, notwithstanding any action pursuant to subsection (a) of this section. Nothing in this article shall limit any person who has been injured by an open burning from pursuing any available remedy at law or equity to which he may be entitled.
