§ 50-17. Disorderly houses.

  • This section is cumulative of O.C.G.A. Per O.C.G.A. § 16-11-44, a person who keeps and maintains, either by himself or others, a common, ill-governed, and disorderly house, to the encouragement of gaming, drinking, or other misbehavior, or to the common disturbance of the neighborhood or orderly citizens, is guilty of a misdemeanor. An example thereof is a recurrence of loud parties at an address, with juveniles or others intoxicated from drinking or under the influence from using marijuana, with loud music (loud enough to radiate out over the neighborhood which noise could be heard a block away), which parties are not casual occurrences but general, customary habits of the house, common occurrences. Each party must exist for a sufficient length of time to render it a common disorderly house, generally two hours or more per party, and the noises made and partying therein disturb the peace of a number of orderly citizens in the neighborhood.
